VIVID MEDIA COMPANY – WEDDING DESIGN TERMS & CONDITIONSLast updated: 10/06/2025 These terms apply to all design work created by Vivid Media Company, LLC (“Vivid,” “we,” “our”) for any client (“you,” “your”) who books a wedding-related project through us. By paying an invoice, signing a proposal, or submitting our project form, you agree to these terms. 1. What You’re Hiring Us For You’re hiring Vivid to provide design-only services for your wedding. That may include invitations, save-the-dates, day-of graphics, logos or monograms, websites, and scheduled social-media graphics depending on the package you choose. We do not handle printing, mailing, or paid advertising. We deliver finished digital design files that you can print or share however you like, website page design and publishing, and Facebook page and event creation, publishing, and automatic posting according to the specifications given. 2. What Each Package Includes Essentials Package – $595 * Custom design for one save-the-date and one wedding invitation * Up to three day-of single page designs (you choose from items such as seating chart, itinerary, menu, table number, signage, or program) * A Branding Pack (logo/monogram, color palette, and font pairing) delivered in an easy to reference graphic. * Two revision rounds on each design * First proof within 2 weeks after we receive your questionnaire, materials, and full payment * Delivery of print-ready PDF/PNG files and our printing guide * As long as the wedding date is at least 6 months away, we intend for all deliverables to be complete up to 4 months prior to the wedding. For weddings within 6 months, availability and timeframe will be considered based on the event. Determinations of deadlines will be relayed prior to the final agreement. Elevated Package – $995 Everything in the Essentials Package plus a custom wedding website design (published and managed through Wix website manager). * Websites are limited to single page only. * Additional pages will be billed at an additional $75 per page) * We design, publish, and host the website up to one week after the wedding. The client will be added to the site and may make edits as desired. * Three revision rounds total for all website edits. Once three revisions of the site have been requested, no further edits will be made. The client reserves the right to edit the site to their liking. * Two months of website hosting and the domain purchase cost is covered in your payment. Any further requested months will be billed separately. * As long as the wedding date is at least 6 months away, we intend for all deliverables to be complete up to 4 months prior to the wedding. For weddings within 6 months, availability and timeframe will be considered based on the event. Determinations of deadlines will be relayed prior to the final agreement. Prestige Package – $1,595 Everything in Elevated plus pre-event social-media setup and design * Creation of a Facebook wedding page and event * Scheduling of up to eight posts during the two months before the wedding (via Meta Business Suite or OneUp) * Posts may include: engagement photos, invitation graphic, registry details, location info, countdown, thank-you post, and two brand-matched fillers. * Each post is allowed three rounds of revisions. * No DM responses, comment moderation, or paid ads included * As long as the wedding date is at least 6 months away, we intend for all deliverables to be complete up to 4 months prior to the wedding. For weddings within 6 months, availability and timeframe will be considered based on the event. Determinations of deadlines will be relayed prior to the final agreement. 3. What’s Not Included Unless clearly listed in your package, the following are not included: * Printing or postage * Physical production, packaging, or delivery of printed items * Extra design items beyond the counts above * Custom coding or third-party plugin development for websites * Social-media management beyond scheduled posts and page and event creation. * Stock photo or font licensing outside our standard library Extra work can be added through a written change order at our current hourly or flat rate. 4. Your Part of the Process To keep things on schedule, you agree to: * Complete our questionnaire and send all text, photos, and details we request. * We are only able to work with non copyrighted readily available design elements, and any approved design elements provided by you. * Confirm that you have permission to use all photos, fonts, and wording you submit. * Review proofs promptly and give clear feedback within three business days when possible. Delays in sending materials or approvals will delay your project. 5. Payment * Full payment is due up front through our secure Relay invoice. * Proposals and quotes are valid for 72 hours. * Once work has begun, payments are non-refundable. * Work begins only after we receive payment in full and all required information. 6. Revisions Each package includes the number of revision rounds listed above. A revision round means a group of edits delivered at the same time. Major redesigns or extra rounds are billed separately. If you don’t respond to a proof within 14 days, the project may be paused or closed. 7. Delivery & File Storage Final files are delivered through email. We store project files for 60 days after delivery; afterward they may be deleted. File retrieval after that window may include a small retrieval fee. 8. Printing & Color Disclaimer Because every printer and screen shows colors differently, slight variations may occur. We’re not responsible for printing or production errors by third-party printers. You’ll receive our printing guide with tips to help your chosen printer achieve the best results. 9. Websites For Elevated and Prestige packages: * Vivid Media reserves ownership of the site and its hosting within the confines of the agreement. You will be added as a user on the site and will have full access to edits, changes, etc. * Client edits made to the site must be approved by Vivid Media, and unapproved edits may result in cancellation of the project. * Vivid Media Company will be the official owner of the purchased domain, which will be canceled upon completion of the project. * Website ownership may be transferred to the client upon request. * Ongoing maintenance or edits after final approval and revision limits are met are not included. 10. Social Media (Prestige Package) * We create and schedule the pre-event posts only and potentially one post event "Thank you" or follow up post. * You remain responsible for sending invites, approving posts, and interacting with guests. * We don’t manage comments, messages, or ads. 11. Communication All client communication happens through Nextiva email or text so our team can stay coordinated. We aim to reply within one business day. Verbal promises or side messages aren’t binding unless confirmed in writing. 12. Copyright & Use Rights After you pay in full: * You receive a permanent personal-use license for your wedding. * You may print, post, and share your files for personal use. * You may not resell, redistribute, or claim the designs as your own. * Vivid keeps ownership of working files and may reuse general design elements. * Unless you request otherwise in writing, Vivid may showcase your designs in our portfolio or social media. 13. Cancellations & Project Pauses Once the work has begun, payment is nonrefundable. If you go silent for more than 14 days, we may pause the project. Restarting may require a restart fee or new schedule. 14. Our Responsibility We promise to deliver original design work consistent with your questionnaire and chosen package. If something is unclear, we’ll communicate promptly and make reasonable corrections within the revision limits. Our total liability for any claim is limited to the amount you paid for that project. We aren’t responsible for indirect damages such as lost printing costs, missed deadlines caused by outside vendors, or event changes. 15. Force Majeure We’re not liable for delays caused by events outside our control—such as illness, power outages, natural disasters, or internet failure—but we’ll keep you informed and resume work as soon as possible. 16. Disputes & Governing Law These terms are governed by the laws of the State of Indiana. Both parties agree to try to resolve any dispute in good faith. If that fails, any unresolved dispute will go to binding arbitration in Putnam County, Indiana. 17. Entire Agreement These Terms, together with your invoice and questionnaire, make up the entire agreement between you and Vivid. No verbal statements or other communications change the agreement unless we both confirm it in writing. Vivid Media Company Privacy Policy This Privacy Policy describes Vivid Media Company policies and procedures on the collection, use and disclosure of your information when you use our service and tells you about your privacy rights and how the law protects you. We use your personal data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. Vivid Media Company is committed to safeguarding the privacy of our users. We want to assure you that we do not share your personal information with third parties. This privacy policy outlines how we collect, use, and protect the information you provide to us. INFORMATION COLLECTION: We collect only the information necessary to provide and improve our services. This may include your name, email address and phone number. We do not sell, rent, or share this information with any third parties. HOW WE USE YOUR INFORMATION: The information collected is used solely for communicating with you as the intended party. We do not share your information with external parties for marketing or any other purposes. We may use personal data for the following purposes: • To provide and maintain our service, including to monitor the usage of our service. • To manage your Account: to manage your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user. • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or of any other contract with us through the Service. • To contact You: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation. • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information. • To manage your requests: To attend and manage your requests to us. All messages you send through the Service, whether to us or other users, are stored on our servers. Vivid Media Company employs servers and services owned by third parties to retain these messages. SMS DISCLOSURE By reaching us by SMS, you agree to receive recurring messages from Vivid Media Company. Message and data rates may apply. Message frequency depends on your interactions and preferences. You can reply STOP to opt-out of future messages or HELP for more information. DISCLOSURE OF YOUR INFORMATION Vivid Media Company does not share any client data with third parties for marketing, promotional purposes, or any other purposes. Your personal information is kept confidential and is not disclosed to any outside organizations, except as required by law or with your explicit consent. We may disclose your personal Information under the following limited circumstances: • We have obtained your consent. • We need to enforce our Terms of Service. • We share information with partners or affiliates that have signed non-disclosure agreements with us only to provide you with a specific service. • We may provide such information to a company controlled by or under common control with Vivid Media Company for any purpose allowed by this Policy. • We respond to subpoenas, court orders, or legal processes, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims. • When we believe it is necessary to disclose Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, potential threats to anyone’s physical safety, violations of Vivid Media Company Terms of Service, or as otherwise required by law. • We transfer Personal Information about you if Vivid Media Company or its assets are acquired by or merged with another company. We may share aggregated, non-identifiable information with others without further notice to you, such as the total number of people who used the Service in a specific month or the total number of messages sent during a particular period.
